Retake Creative Studio – Branding and Brand Production Services
1. Scope of Services
Retake Photo agrees to provide branding, professional photography and/or videography services (the “Services”) as outlined in the applicable proposal, estimate, or order confirmation agreed upon by the Client. Services may include still photography, video capture, editing, post-production, and delivery of final media files.
2. Booking and Payment
A non-refundable deposit of [% of total project fee] is required to secure booking.
Remaining balance must be paid in full before or on the delivery of final media unless otherwise agreed in writing.
Additional services, including extra shooting time, reshoots, or expedited delivery, will be billed at the rates listed in the current pricing schedule.
3. Client Responsibilities
Client shall provide access to locations, subjects, and any required permissions or permits for the Services.
Client is responsible for securing releases from individuals, venues, or brands featured in the content. Retake Photo may provide model/property release forms upon request.
Client agrees to communicate creative direction and brand guidelines in advance.
4. Intellectual Property and Usage Rights
Ownership: Retake Photo retains full copyright ownership of all photographs and video content created.
License to Client: Upon full payment, Client receives a non-exclusive, royalty-free license to use the final media for marketing, promotional, and branding purposes across digital and print platforms.
Restrictions: Client may not resell, sublicense, or transfer rights to third parties without written permission from Retake Photo.
Retake Photo reserves the right to use media for portfolio, self-promotion, and marketing purposes unless Client provides written notice requesting otherwise.
5. Revisions and Deliverables
Standard deliverables include fully edited photographs and/or video files in digital format.
One (1) round of reasonable revisions is included in the fee. Additional edits will be billed at Retake Photo’s hourly editing rate.
Delivery timelines will be mutually agreed upon. Rush delivery is subject to additional fees.
6. Cancellations and Rescheduling
Cancellations made less than 7 days before the scheduled shoot are subject to a cancellation fee.
Rescheduling is permitted once without penalty, provided notice is given at least 14 days prior to the original date.
7. Liability
Retake Photo will take reasonable measures to ensure professional results; however, we are not liable for circumstances beyond our control (e.g., weather, venue restrictions, equipment failure, accidents).
In the event of unforeseen technical failure or inability to deliver media, Retake Photo’s liability is limited to a refund of amounts paid by the Client.
8. Confidentiality
Retake Photo agrees to maintain confidentiality regarding any proprietary or sensitive information shared by the Client in connection with the Services.
9. Governing Law
This Agreement shall be governed by and construed under the laws of the state of Florida, without regard to conflict of law principles.
10. Entire Agreement
Agreement constitutes the full understanding between Retake Photo and the Client. Any amendments must be made in writing and signed by both parties.
